Insurance company crisis finds homeowners left in state of uncertainty and being ignored

Florida’s property insurance crisis is not just about skyrocketing rates or insurers pulling out of the state, it is also about a system that is so broken that thousands of consumer complaints still do not have a resolution. Florida experienced some of the sharpest home insurance premium increases in the entire country last year which has created a challenging environment for homeowners.

An investigation by WPTV revealed that insurance companies in the Sunshine State have been delaying the handling of claims for months.

There are growing concerns about whether consumer insurance complaints are being reported and addressed properly. Specifically, the Office of Insurance Regulation (OIR) has expressed worries that the Office of the Chief Financial Officer (CFO), led by Jimmy Patronis, may have underreported complaints. This underreporting complicates the ability of regulators to effectively oversee the insurance industry.

At its core? A turf war between the Florida Office of Insurance Regulation (OIR) and the Department of Financial Services (DFS) that went on for years and put state power struggles tugging on one another’s chains in front of protecting Floridians.

Sharp criticism of one state agency by another, Florida’s Office of Insurance Regulation told legislators that a department led by then-Chief Financial Officer Jimmy Patronis may have buried thousands of complaints Floridians made against property insurance companies.

What is OIR?

OIR, which stands for Office of Insurance Regulation, plays a crucial role in regulating the insurance industry in Florida. Their primary responsibility is to oversee and enforce laws regulated to insurance and fairness to both insurers and consumers.

What is DFS?

DFS, which stands for Department of Financial Services, is a state agency headquartered in Tallahassee. Responsibilities include overseeing insurance regulation.

There is significant concern in Florida regarding the adequacy of reporting and addressing homeowners’ insurance consumer complaints. Specifically, issues have been raised about how claims are managed, the speed of responses, and whether insurers are fulfilling their duty of good faith and fair dealing. The Florida Office of Insurance Regulation (OIR) is responsible for monitoring the conduct of insurance companies and addressing consumer complaints.
